Vivation Licensing Agreement
By becoming a licensed Vivation Professional you must agree to protect the lineage, which includes the proprietary teaching methods, models, and materials you will be given during the training.
USER LICENSING AGREEMENT; Vivation International Restricted Materials

USER LICENSING AGREEMENT (“Agreement”)
Vivation International, the Licensor, has produced a unique set of restricted materials (written, audio, and video) that are made available to students both in person, through email, and on our website, which are protected by copyright law and are the sole intellectual property of Vivation International as the Licensor. Access to these materials will only be granted with your agreeing to and signing this Agreement.
In order to protect the integrity of these teachings embodied in the materials, your rights to use of these proprietary Materials are strictly limited as the Licensee(s) under the terms set forth in this Agreement. Your signing the Agreement constitutes full acceptance of these terms.
Upon acceptance and signing of this Agreement, you as the Licensee(s) agree that these Materials are only to be used as a support for your personal practice or teaching role. By acceptance of this Agreement you agree that you are not to copy any portion of these Materials in order to share them with any other individual, unless you are a certified Vivation Professional sharing Seven Basic Lessons materials with your students. Any materials that are for Vivation Professionals only, are not to be shared with anyone, including other Vivation Professionals. These materials are for you, and you alone, to protect.
In accepting this Agreement you fully understand and acknowledge that a breach of this Agreement by making any unauthorized copy of the Materials will cause extraordinary damages to the Licensor. Given the unique nature of the Materials and the damages that can be caused by unauthorized copying, distribution or use of the Materials, those damages are difficult to quantify. Therefore, by accepting this Agreement you are acknowledging the severity of those damages and the difficulties in quantifying them, and pre-agreeing to pay liquidated damages in the amount of $50,000 for each violation of the terms of this Agreement should a lawsuit be brought against you by the Licensor. You further agree to pay the reasonable attorney’s fees and court costs for bringing such a lawsuit.
The liquidated damages agreed to above shall be additional to those proscribed under U.S. Copyright Law. Sharing the unique content or recordings of these Materials with others runs the risk of a civil lawsuit for copyright violation and violation of intellectual property rights. U.S. Copyright law provides damages of up to $150,000 for willful infringements, and also provides for recovery of attorney fees and court costs in the case of copyright violations. By pre-agreeing to the terms of this Agreement, the Licensee(s)runs the risk of additional liquidated damages of up to $50,000 for violation of the terms of this licensing agreement. Accordingly, your violation of this Agreement or unauthorized use of these Materials shall result in hundreds of thousands of dollars in liability to the licensor, plus the fees and cost he incurs in bringing a lawsuit against you.
Any dispute arising under or connection with the subject matter of this Agreement and/or the use of these Proprietary Materials shall be subject to the exclusive jurisdiction of the state and federal courts located in Casper, WY.
